Welcome to Pattern AI Making(“Pattern AI Making”, “the Service”). These Terms of Service (“Terms”) are a binding agreement between you and Quelper LLC (“we”, “us”, “our”), the company that operates the Service. By accessing or using Pattern AI Making in any way, you agree to these Terms. If you do not agree, do not use the Service. Questions: legal@patternaimaking.com.
You must be at least 18 years old to use the Service. If you are using the Service on behalf of a company or other organization, you represent that you are authorized to bind that entity to these Terms, and “you” refers to that entity.
Pattern AI Making is an AI-assisted tool that helps generate draft technical packages (“tech packs”) and draft sewing patterns from images, sketches, measurements and other inputs you provide. The Service is currently in active research & development / early access and is provided on an evolving basis.
AI transparency. You acknowledge that you are interacting with an automated artificial-intelligence system and that the tech packs, patterns and related content the Service produces are generated by AI. They are drafts, not professional advice, and must be reviewed by a qualified human before any production use (see Section 3).
All outputs of the Service are drafts intended for review by a qualified patternmaker, technologist or other professional. They are not finished, verified, or guaranteed production-ready specifications. You are solely responsible for independently reviewing, testing, sampling and verifying any tech pack or pattern before cutting fabric, manufacturing, or relying on it for any commercial purpose. We do not warrant the accuracy, fit, suitability, completeness, or manufacturability of any output, and we are not responsible for any materials, samples, production runs, costs, or losses arising from use of the outputs.
You retain the rights you hold in the images, sketches, measurements and other materials you upload (“Inputs”). You represent and warrant that you have the necessary rights to upload your Inputs and that they do not infringe any third-party rights or applicable law. You grant us a worldwide, non-exclusive license to host, process and use your Inputs and the resulting outputs as needed to operate, provide, secure and improve the Service. Subject to these Terms, you may use the outputs you generate for your own purposes.
The Service, including its software, models, designs, and underlying technology, is owned by us and our licensors and is protected by intellectual-property laws. Except for the limited rights expressly granted to you, no rights are transferred to you. You may not copy, modify, reverse engineer, decompile, or attempt to extract or reconstruct the Service or its underlying technology.
The Service is provided on an “as is” and “as available” basis. Features may change, break, or be discontinued, and we make no guarantee of availability, uptime, or backward compatibility.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, MATERIALS, PRODUCTION, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY OUTPUT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE PRIOR TWELVE MONTHS OR USD 100.
You agree to indemnify and hold us harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your Inputs, your use of the Service, your reliance on any output, or your breach of these Terms.
We may update these Terms from time to time. We will post the updated Terms on the Service and update the effective date. Your continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply.
